KELLER WILLIAMS LAKESIDE TERMS OF USE

Please read these Terms of Use (“Agreement”) carefully. This Agreement is a legal contract between you and Keller Williams Lakeside (“Keller Williams Lakeside,” “KW Lakeside,” “we,” “us,” or “our”) governing your access and use of any website or mobile application operated by us (collectively, the “Services”).
By accessing or using the Services, registering an account, or clicking any button marked “I agree,” you accept this Agreement and agree to comply with its terms.
Keller Williams Lakeside is an independently owned and operated real estate brokerage affiliated with Keller Williams Realty. This Agreement applies solely to Keller Williams Lakeside and its Services and does not apply to any other Keller Williams entities, Market Centers, or agents.
1. Effective Date
The “Last Updated” legend above indicates when this Agreement was last revised. We may change these Terms at any time by posting an updated version on our website. Continued use of the Services following such changes constitutes acceptance of the revised Agreement.
2. License to Use the Services
Subject to compliance with this Agreement, Keller Williams Lakeside grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for personal, informational, and professional purposes related to real estate. All rights not expressly granted are reserved by Keller Williams Lakeside and its licensors.
3. Registration; Usernames and Passwords; Communications
You may be required to register an account to access certain Services. You agree to provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activities under your account.
By providing your phone number or email address, you consent to receive communications from Keller Williams Lakeside by telephone, text message, or email, including marketing communications. Message and data rates may apply. You may opt out at any time as described in our Privacy Policy.
4. Information Collected Through the Services
You agree that we may collect, use, and share information as described in our Privacy Policy, including automatic collection of certain device and usage data. You warrant that any information you provide is accurate and that you have all necessary rights to share it with us.
5. Your Conduct
You agree not to:
- Use the Services for unlawful, fraudulent, or harmful purposes.
- Post, upload, or transmit any content that is defamatory, obscene, threatening, or infringes the rights of others.
- Introduce viruses or malicious code.
- Attempt to gain unauthorized access to our systems.

- Impersonate others, send spam, or interfere with the proper functioning of the Services.
We reserve the right to monitor use, remove content, and suspend access for violations of this Agreement.

The Services may contain links to third-party websites or applications (“Third-Party Materials”). Keller Williams Lakeside does not control or endorse, and is not responsible for, the content, terms, or policies of any Third-Party Materials. You access such sites at your own risk.
7. Artificial Intelligence Tools
Some Keller Williams Lakeside Services may utilize artificial-intelligence (AI) technologies. By using these features, you acknowledge that AI outputs may be inaccurate, incomplete, or biased and that you are responsible for verifying their accuracy and compliance with applicable laws before relying on them.
8. Transactions
If you make a purchase or payment through our Services, you agree to provide accurate billing information and authorize us to charge your chosen payment method. All sales are final unless otherwise stated. You are responsible for all applicable taxes.
9. Feedback and Submissions
Any ideas, suggestions, or feedback you submit to Keller Williams Lakeside are deemed non-confidential and may be used freely by us for any lawful purpose without compensation to you.
10. Proprietary Rights
All content and materials on the Services, including text, graphics, logos, and software, are owned or licensed by Keller Williams Lakeside and are protected by intellectual-property laws. You may not reproduce, distribute, or modify any content without prior written consent.
11. Disclaimer of Warranties
The Services are provided “as is” without any warranties of any kind, express or implied. Keller Williams Lakeside does not guarantee that the Services will be error-free, uninterrupted, or secure. Your use of the Services is at your own risk.
12. Limitation of Liability
To the fullest extent permitted by law, Keller Williams Lakeside, its owners, agents, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the Services. Our total liability to you for any claim shall not exceed fifty dollars ($50.00).
13. Indemnification
You agree to indemnify and hold harmless Keller Williams Lakeside, its affiliates, officers, agents, and employees from any claims, damages, or expenses arising from your use of the Services or violation of this Agreement.
14. Termination
We may suspend or terminate your access to the Services at any time without notice if we believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately.
15. Governing Law
This Agreement is governed solely by the laws of the State of Michigan, without regard to conflict-of-laws principles. You agree that any legal action arising under this Agreement shall be filed exclusively in the state or federal courts located in Macomb County, Michigan.

17. Copyright Infringement Claims
If you believe content on our website infringes your copyright, please send a written notice including details of the alleged infringement to technology@kwlakeside.com. We will promptly investigate and remove infringing material as appropriate.
18. Export Controls and International Use
The Services are intended for use within the United States. You are responsible for complying with all U.S. export laws and local laws applicable to your access and use of the Services.
19. Miscellaneous
If any provision of this Agreement is deemed unenforceable, the remaining provisions will remain in effect. Failure by Keller Williams Lakeside to enforce any right does not constitute a waiver. This Agreement represents the entire understanding between you and Keller Williams Lakeside regarding your use of the Services.

SMS Consent Communication:
The information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
